Terms of Service

These Terms of Service ("terms") are an agreement between you and Badger Social Inc., 131 Continental Drive, Newark, DE 19713, United States ("we", "us"). They cover the Operation Blast iPhone app, the leaderboards and other online features behind it, and the website at operationblast.com (together, "the game"). By installing or playing the game you agree to these terms and to our Privacy Policy, which explains what the game stores about you. If you do not agree, do not install or play.

These terms contain a binding arbitration agreement and a class-action waiver (section 12) that affect your legal rights. Please read that section.

If you are a parent or guardian whose child plays Operation Blast, these terms apply to you on your child's behalf, and you are responsible for your child's play, including any purchases made on your device.

1. What Operation Blast is

Operation Blast is a portrait arcade shooter. Your hero runs down a track shooting zombies with a blaster; math gates change how much ammo you carry, and the right answer keeps you alive. There is a campaign of levels and a Daily Run, an endless mode with public daily, weekly and all-time leaderboards. Coins earned in play (or bought) unlock heroes, upgrades and continues in the shop.

2. Who can play

• Anyone can download and play the game. It works offline and does not need an account.
• You must be at least 13 years old to have a public username and appear on the public leaderboards. The game asks for your birth year on the username screen. If the year you give means you turn 13 or younger this calendar year, the game does not create a public username for you and does not post your scores to the leaderboards; everything else plays the same. If you are under 13 and skipped the year, do not create a username; ask a parent or guardian to play with you. A parent or guardian can have a child's username and scores removed at any time by emailing support@operationblast.com (see section 8 of the Privacy Policy).
• If you are under 18 (or the age of majority where you live), you may play only with the permission of a parent or guardian, and any purchase needs their approval. Apple's Screen Time, Ask to Buy and Family Sharing settings let parents control purchases on a child's device.
• You may not play if the law where you live forbids it, or if we have blocked your player identity for breaking these terms.

3. Your licence to play

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and play the game on Apple devices you own or control, as Apple's App Store terms allow. The game is licensed to you, not sold. You may not:

• copy, modify, decompile or reverse-engineer the game or its content, except where the law allows it;
• sell, rent, lend or redistribute the game or any virtual item;
• use cheats, bots, modified copies of the game, memory editors, automation, or any other method that changes how the game runs or what it sends to our servers;
• interfere with our servers, the leaderboards or other players' access to them;
• use the game for anything unlawful.

4. Your player identity and username

• The game creates an anonymous player identity for your install: a random id, with no email and no password. If you delete the game or move to a new device, that identity is gone: progress, coins and Second Chances do not carry over, and because we do not know who you are, we cannot prove that an identity was yours or restore it. The Unlimited Pass is tied to your Apple ID and can be restored (section 5). Keep the game installed if you want to keep your progress.
• Your username is public. It appears on the leaderboards next to your score, together with your short player id, for anyone who opens them. Choose something you are happy to show strangers; do not use your full real name or anything else that identifies you personally.
• Usernames are 3 to 16 letters and digits, one per player, first come first served. You can change yours in Settings; the old name stays reserved and is not released to other players.
• Do not choose a username that impersonates another person, a brand or the game's team; that is offensive, sexual, hateful or harassing; or that contains contact details or advertising. We may change, reset or block a username at any time, without notice, when we think it breaks these rules.

5. Virtual items and purchases

• The game sells, through Apple's App Store: coin packs (consumable), Second Chance packs (consumable) and the Unlimited Pass (a one-time, non-consumable purchase that removes the daily limit on campaign runs). Prices are shown in the App Store and in the game's store before you buy.
• Apple handles billing, receipts and refunds. We never see your payment details. To ask for a refund, use Apple's refund process (reportaproblem.apple.com); we cannot issue refunds ourselves. After a reinstall or on a new device, restore the Unlimited Pass with RESTORE PURCHASES in the store. Consumables (coins and Second Chances) are spent in play and cannot be restored.
• Virtual items have no cash value. Coins, Second Chances, heroes, upgrades, the Unlimited Pass and anything else inside the game are a limited licence to use a feature of the game. They are not your property, cannot be sold, transferred, exchanged for money or moved to another player identity, and we may change what they do, what they cost, or whether they are offered at all.
• Coins and Second Chances can also be earned in play; every item in the shop can be reached without paying.
• Four free campaign runs a day. Without the Unlimited Pass the campaign allows four level starts per day (measured in UTC). The Daily Run is not limited. A retry counts as a start; a Continue does not.
• If we stop operating the game (section 7), unused virtual items end with it and are not refunded, except where the law requires otherwise.

6. Fair play and leaderboards

• Scores are computed on your device and sent to our servers. You agree not to fake, replay, edit or automate them.
• We may remove or reset any score, username or leaderboard entry that we believe is the result of cheating, tampering, exploiting a bug or a technical fault, and we may block the player identity behind it, without notice.
• Leaderboards are for fun. There are no prizes, no entry fee and no element of chance; a position on a board is not a right, and the boards are not a contest or sweepstakes.
• To report a suspicious score or an offensive username, email support@operationblast.com with the username and the board you saw it on.

7. Availability and changes to the game

• We may update, rebalance, add or remove levels, features, virtual items, prices and leaderboards at any time. You may need to install an update to keep playing.
• Online features need an internet connection and depend on our servers and on Google's Firebase service being available. Offline, the game still plays; leaderboards and username changes wait until you are back online.
• We may suspend or end the game or its online features. If we shut the game down we will give at least 30 days' notice in the App Store listing or in the game where we reasonably can.

8. Intellectual property

Operation Blast, its name and logo, heroes, art, music, sounds, levels, code and text belong to Badger Social Inc. or our licensors and are protected by copyright and trademark law. These terms give you no rights other than the licence in section 3. You may record and share screenshots and videos of your own play for personal, non-commercial purposes. If you send us feedback or ideas, we may use them without any obligation to you.

9. Disclaimers

The game is provided "as is" and "as available". To the extent the law allows, we make no warranties, express or implied, about the game, including that it will be uninterrupted or error-free, that it will work on your device, or that scores, leaderboards or saved progress will never be lost. Some places do not allow these exclusions, so you may have rights that these terms cannot limit.

10. Limitation of liability

To the extent the law allows, Badger Social Inc. and its owners, staff and suppliers are not liable for indirect, incidental, special, consequential or punitive damages, or for lost data, lost progress, lost virtual items or lost profits, arising from the game. Our total liability for all claims related to the game is limited to the greater of the amount you paid for in-app purchases in the twelve months before the claim and US$100. Nothing in these terms excludes or limits liability that cannot be excluded or limited by law, including liability for death or personal injury caused by negligence, for fraud, or under your statutory consumer rights.

11. Termination

You can stop at any time by deleting the game, which also deletes the save on your device (the Privacy Policy explains what stays on our servers and how to have it removed). We may suspend or end your access to the online features, or block your player identity, if you break these terms or if we must for legal or security reasons. Sections 5, 6 and 8 to 15 survive the end of these terms.

12. Governing law and disputes

Please read this section carefully: it affects how disputes are resolved.

These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules, except where mandatory consumer protection or local law applies to you. Subject to the arbitration agreement below, the state and federal courts located in Delaware have jurisdiction over any matter not subject to arbitration.

• Informal resolution first. Before filing a claim, you agree to contact us at support@operationblast.com and give us 30 days to try to resolve the dispute informally.
• Binding arbitration. Except as noted below, any dispute arising out of or relating to these terms or the game will be resolved by final and binding individual arbitration administered under the rules of a recognized arbitration provider, rather than in court. The arbitration will be conducted in the English language.
• Class-action waiver. You and we agree to bring claims only in an individual capacity, and not as a plaintiff or class member in any class, collective or representative proceeding. The arbitrator may not consolidate more than one person's claims.
• Exceptions. Either of us may bring an individual claim in small-claims court, and either of us may seek injunctive relief in court for intellectual-property or unauthorised-access matters. Where required by law (including for certain minors or jurisdictions, such as consumers in the EU and the UK), arbitration and the class waiver may not apply, and nothing here waives any non-waivable right.
• Opt-out. You may opt out of this arbitration agreement within 30 days of first accepting these terms by emailing support@operationblast.com with your username or player id and a statement that you opt out.

13. Apple App Store terms

Because the game is distributed through Apple's App Store, Apple requires the following, which applies in addition to everything above:

• These terms are between you and Badger Social Inc., not Apple. Apple is not responsible for the game or its content.
• The licence in section 3 is limited to use on Apple-branded devices that you own or control, as permitted by the Usage Rules in Apple's Media Services Terms and Conditions, except that the game may be accessed by other accounts associated with you through Family Sharing or volume purchasing.
• We, not Apple, are responsible for maintenance and support of the game. Apple has no obligation to provide any support for it.
• If the game fails to conform to any warranty that applies, you may notify Apple, and Apple will refund what you paid for the app (the game itself is free to download). To the extent the law allows, Apple has no other warranty obligation, and any other claim, loss or cost is our responsibility.
• We, not Apple, are responsible for handling any claim by you or a third party relating to the game, including product liability claims, claims that the game fails to meet a legal or regulatory requirement, and claims under consumer protection or similar law.
• If a third party claims that the game infringes their intellectual property, we, not Apple, are responsible for investigating, defending, settling and discharging the claim.
• You confirm that you are not located in a country subject to a United States government embargo or designated by the United States government as a "terrorist supporting" country, and that you are not on any United States government list of prohibited or restricted parties.
• You must comply with any third-party terms that apply when you use the game (for example, your wireless carrier's terms).
• Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

14. Changes to these terms

We may change these terms as the game changes. The version and effective date at the top of this page tell you which terms apply. For a material change we raise the terms version in the game, so the terms are shown to you again and you are asked to accept them before you keep playing. A small change (wording, contact details) only updates this page and its date. Earlier versions are available on request. If you do not agree with a change, stop playing and delete the game.

15. General

These terms and the Privacy Policy are the whole agreement between you and us about the game. If a part of these terms turns out to be unenforceable, the rest still applies. If we do not enforce a part of these terms, we have not given up the right to do so later. You may not transfer these terms to anyone else; we may transfer them if the game changes hands, and we will tell you if that happens.
